Desde 1978, con la aprobación de la Constitución, no es posible apelación alguna en nuestras leyes a consideraciones de tipo "moral". Ninguna moral en especial prevalece sobre otra a la hora de ser protegida por las leyes. El derecho al desnudo, por tanto, se deduce de nuestra Constitución (Art. 1º; Arts. 14, 17 y 20; Arts. 138, 139 y 149).

El naturista reclama el derecho de estar desnudo, liberando la visualización de su cuerpo. No pone su cuerpo a disposición de todo el mundo (eso seria dominio público), ni es un exhibicionista que quiere que le miren (eso es freeware), ni es como las prostitutas que muestran su desnudez esperando que pagues por el servicio (eso es shareware). Tampoco se puede comparar la desnudez del naturista con la desnudez de los profesionales de las revistas o el cine-X (eso es software propietario).
